Members' Terms and Conditions
1. Company information. Green Escapes Travel Limited (trading as “Green Escapes”) is registered in England. Our registered company number is 6189439 and our registered office address is 4 Coleman Avenue, Hove, East Sussex BN3 5NB.
2. Contract. If you are taking advantage of the one year free advertising promotion, a contract comes into force when you submit your online advertising form to Green Escapes Travel Limited (“Green Escapes”). Otherwise, a contract comes into force between the advertiser (“you”) and Green Escapes when you submit payment for the services provided by Green Escapes. Until payment is submitted, there is no binding agreement between you and Green Escapes. If payment is made by cheque, a binding agreement comes into force when you confirm your registration details on the Green Escapes site. If you are taking advantage of a free advertising period, the contract comes into force when you confirm your registration details on the Green Escapes site.
3. Payment. When a new property is registered on the site, payment must be made on that same day (unless you are taking advantage of the one year’s free advertising. If payment is being made by credit or debit card this can be processed online by PayPal, our online card payment provider. If you are unable to make payment by card, please send a cheque payable to Green Escapes Travel Limited on the day of registering a property to Green Escapes, 16 Elm Road, Portslade, East Sussex BN41 1SA. We ask that you notify Green Escapes by email that a cheque has been sent and advise of the expected time of receipt, especially where this is expected to be more than 10 working days from the date of registration of a property. Green Escapes reserve the right to remove property advertisements should no notice be given by email and if payment is not received within 10 working days.
4. Your responsibility for your webpage. It is your sole responsibility to ensure that the content of your webpage is kept up-to-date, accurate and free from unlawful and/or prohibited information. It is a condition of this contract that you agree not to use this site for any purpose that is unlawful and/or prohibited.
5. Site visits. Green Escapes reserve the right to visit and inspect your property or service at any time to check that the information advertised on your page is accurate and up-to-date. We will provide you with at least 24 hours notice if we wish to visit. Green Escapes reserve the right to request at any time written information to substantiate your green fact-file to be sent by post or email.
6. Green Escapes’ right to amend your web page. Green Escapes reserve the right to determine the final design layout of the website, including the right to edit copy, or amend layouts or photographs supplied. Green Escapes also reserve the right, to amend and edit copy entered into the online database. Green Escapes cannot be held responsible for any loss, or damage, resulting from the design, or positioning of the properties, or changes made to the photographs and copy submitted by you.
7. Your copyright. You agree that you either own the copyright in the photographic and textual material for use on the site or that you have the consent of the owner of the copyright to grant Green Escapes permission to use it. You agree to grant Green Escapes a perpetual, royalty-free licence to use the material for promotional purposes (including marketing and public relations material). You understand that you may not reproduce photographic or textual material from any part of the Green Escapes website without permission from the relevant copyright owner.
8. Green Escapes’ Copyright. Material and software on these sites is the sole copyright of Green Escapes. Other than using it for your own personal use, the material may not otherwise be used or copied without the prior written approval of Green Escapes.
9. Multiple properties. An advertisement on the Green Escapes site is one unit of property or service. Only one unit should be represented in an advertisement unless the prior permission has been given to you. Green Escapes reserve the right to amend any property adverts not adhering to this policy and splitting them into multiple pages.
10. Exchanging properties. An advertisement on the Green Escapes site relates to a specific property or service, and this property or service must not be substituted for another by way of changes to the text and photographs unless prior permission has been given to you. If you have changed the property being described, Green Escapes reserves the right to suspend your advert.
11. Contactability. In the interest of maintaining a high level of service to customers using the site, we require you to be available to respond to enquiries by telephone or email. If you are unavailable for a period of more than 1 week, we ask you to leave an answerphone message or set up an out of office response on your email account. If neither of these options is viable, we ask that you contact us so we can temporarily suspend your advert. We reserve the right to suspend adverts of owners who are unreachable for more than 1 week. In this instance we will send messages by telephone and email asking for the advertiser to request re-activation upon their return.
12. External links. Green Escapes reserves the right to remove from adverts both email addresses and links to external websites which either do not conform to the guidelines provided, or which we feel are not appropriate, or act against the interests of the company or its advertisers. The ultimate responsibility and authority for determining this rests solely with Green Escapes. Should an advertiser add a link or email address without consent, re-add a link or email address after its removal or remove reciprocated links from their website, we reserve the right to cancel their advertising without refund.
13. Termination of contract by Green Escapes. If Green Escapes has not received payment from you within 10 days of registration, we reserve the right to terminate your property page without notice. If Green Escapes receive substantiated complaints from any number of site users about a specific property page misrepresenting the property, or its surroundings, then we reserve the right to terminate your contract without notice, and retain payment. If you attempt to enter unsuitable material into the online database, or persistently misuse the on-line systems, Green Escapes reserve the right to remove the associated property page(s) from the web site. Full payment will be retained. Green Escapes reserve the right to refuse or remove any property or service page from its web site that it considers does not practice responsible tourism or if it is unsuitable or incomplete, and will not be liable for any expense in so doing.
14. Termination of contract by you. If you wish to have your property page removed from the web site before the end of your subscription, this will be done as soon as we receive formal notice from you by email or using the 'contact us' page, quoting your email address to log-in and password. No refunds will be given.
15. Refund policy. Green Escapes provides an advertising service rather than a physical product. We offer a 'cooling off period' of seven working days wherein a customer may cancel the requested advertising by email to isla@greenescapes.co.uk (stating your email address to log-in and password). We will then supply a refund less a £10 administration fee and notification by email.
16. Indemnity. You agree to indemnify Green Escapes in respect of any loss, damages or costs as a result of a breach of contract, of copyright, of statute or of any other legal obligation in respect of your conduct and use of the Green Escapes site.
17. Liability. Green Escapes does not warrant that the operation of the web site will be uninterrupted or error free. In no event shall Green Escapes become liable to you for any special, consequential, incidental or indirect damages, including lost profits, however caused, on any theory of liability, including but not limited to product liability.
18. Changes to pricing and conditions. Green Escapes reserves the right to change the rates and conditions without notice. Any new rates will be applicable immediately for all new adverts and renewals for both new and existing customers.
19. Data Protection. We will not pass on the personal information that you have provided to Green Escapes to any third parties without your prior consent.
20. Law and Jurisdiction. This contract is governed by the law of England and Wales and is subject to English and Welsh jurisdiction.
21. Statement of Truth. You confirm that, to the best of your knowledge, the information that you enter on your member page is accurate and up-to-date.
Consumer Terms and Conditions
1. Responsibility for accuracy and currency of property information. Green Escapes makes no representation as to the accuracy or currency of the information contained within the Green Escapes website. The property details content is the sole responsibility of the owner of the property displayed. Green Escapes has not confirmed the currency or accuracy and accordingly holidaymakers are strongly recommended to make their own investigations into the authenticity of any information supplied. Green Escapes are in no way liable for any inaccuracies or misleading statements made in the information provided by the owner of properties on the website.
2. Green Escapes Copyright. Material and software on these sites is the sole copyright of Green Escapes. Other than using it for your own personal use the material may not otherwise be used or copied without the prior written approval of Green Escapes or the property who listed that information on the sites.
